General terms and conditions

If you do not agree to these terms and conditions applying, you may not register.

By creating a website (the contracting party is Soda Studios AG, Hohlstrasse 402, 8048 Zürich, Switzerland), you accept these terms and conditions, which form an integral part of the contract. Registration establishes a contractual relationship between Soda Studios AG (hereinafter Soda Studios) and you, the user.

Creating a website

By registering with crazyinlove.ch and using the services offered, you acknowledge these terms of use as valid for the use of the services offered by Soda Studios. Registration takes place by submitting the online registration form. Once payment has been received, before or after the free trial website expires, you can use the full offer for the period booked.

The free trial website may only be created for testing purposes and, after payment, used for a single wedding only.

Fees for using the website

Our paid services are activated for 18 months once payment has been received. When this period ends, access is blocked again and the data is deleted automatically. This period can be extended on request.

Changes to the website

The online offer of crazyinlove.ch may be subject to changes or be interrupted temporarily or permanently. Soda Studios is under no obligation to give prior notice. Soda Studios may decide at its own discretion which free services are made available and to what extent. Restrictions, extensions and other changes to these services by Soda Studios are permitted at any time and are likewise subject to these terms of use. Where paid services are offered, Soda Studios reserves the right to adapt them at any time to the state of the art and to the applicable law without the user’s specific consent.

Archiving

Soda Studios is not responsible for archiving information or materials on your behalf.

Property rights

All material (data and software) on crazyinlove.ch is protected by copyright, both as an individual work and as a collection. Users may download and use copyrighted material made available by Soda Studios or third parties exclusively for private use, insofar as this takes place within the scope of the applicable legal provisions and these terms and conditions. However, users may not reproduce, copy, transmit, distribute, publish or commercially exploit this material beyond this scope, convert it in any other way, in electronic or other form, into another data format, or otherwise use it or make it accessible. You confirm that you own the copyright to all photographs you provide to crazyinlove.ch. You agree to fully indemnify Soda Studios against any claim brought against us for infringement or copying of intellectual property rights.

AI functions

In the editor, an AI can write, revise and translate texts for you, create new blocks, suggest a wish list and draw pictures. Texts are generated by Claude from Anthropic, pictures by OpenAI’s image model. For this, Soda Studios transmits the necessary information to these providers: your instructions, the texts concerned and, for “Photo as a drawing”, the chosen photo. The providers do not use this data to train their models. More on this in the privacy policy.

Check the results. An AI can make mistakes, make things up or produce something unwanted. Read what it has written, translated or drawn before you publish it – especially dates, places, names and prices. You are responsible for published AI content just as you are for your own content.

Input. Do not give the AI any content that violates the law or the rights of third parties. For “Photo as a drawing”, only use photos to which you hold the rights and whose editing the people shown have agreed to. The original is kept.

Rights to the results. You may freely use what the AI creates for you, including outside crazyinlove.ch; Soda Studios claims no rights to it. Soda Studios cannot guarantee whether copyright arises in an AI result or whether it happens to resemble someone else’s work.

AI budget. Every website has an AI budget in credits. Each request uses up part of it; the editor shows how many credits are left. The free trial website includes a smaller budget, the activation a larger one, included in the price. Credits have no monetary value, are not transferable and are not paid out. They expire if the trial ends without activation, and when your website is deleted. Once the budget is used up, the AI functions are no longer available; on request, Soda Studios can increase it. To protect against misuse and disproportionate costs, Soda Studios may temporarily limit usage.

Functions marked as “experimental” may change or be discontinued.

Connecting Claude and ChatGPT

You can connect crazyinlove.ch to an AI assistant such as Claude or ChatGPT. In doing so, you log in to crazyinlove.ch and allow the assistant to access your account: it can create, read and edit your website. Activation and payment remain in the editor.

Whatever the assistant does via this connection is deemed to have been initiated by you; check the changes in the editor. The chat itself is governed by the terms and privacy policy of the respective provider, and Soda Studios is not responsible for the assistant’s answers. You can disconnect at any time in the assistant; on request, Soda Studios will also block access for you.

Disclaimer of warranty / limitation of liability

Soda Studios cannot guarantee the smooth functioning of the website, nor an uninterrupted, consistently timely and error-free service. You use the Soda Studios services at your own risk. Soda Studios gives no warranty for the results you expect from using the website, nor for the accuracy or reliability of any information obtained via the website. Soda Studios points out that the identities, statements and information of people active on the internet may be false. Soda Studios exercises no control over content and information from third parties that can be obtained via the website and is released from liability for any claims relating to such third-party content and information. Soda Studios accepts no liability for users complying with the contractual terms, even though the contractual terms clearly state which behaviour is not acceptable on our service; and under no circumstances does Soda Studios accept any liability towards the user for direct or indirect damage or disadvantages arising from the use of the Soda Studios service. Soda Studios accepts no liability for lost information and data of the member. Information and advice that a user receives in connection with crazyinlove.ch, whether on websites, by email, in writing or orally, does not constitute any warranty by Soda Studios unless this has been expressly agreed. Liability for official measures for which Soda Studios is not at fault, labour disputes, force majeure, natural disasters and accidental damage is excluded. You are yourself fully responsible for the information contained on your website, and Soda Studios is solely responsible for the passive forwarding and internet publication of your information. Soda Studios reserves the right to take any measure deemed necessary or appropriate in connection with your information. Soda Studios reserves the right, without prior notice, to change any information/materials deemed to violate these terms, or to remove them from the website in whole or in part. This is entirely at the discretion of Soda Studios – for example, if we believe that your information could give rise to liability on our part. The user is aware that the Soda Studios services could not be provided in the form offered without the above disclaimers of warranty and limitations of liability. The limitation of liability also applies in favour of the employees and agents of Soda Studios. This contract contains no exclusions or limitations of the liability of Soda Studios in the following cases: injury to life, body or health as a result of intent or grossly negligent breach of duty by Soda Studios, its agents or representatives. Beyond this, liability is limited to the typically foreseeable damage. Neither party shall be held liable for breaches of contract that are beyond its control.

Indemnification

You undertake to indemnify Soda Studios and all its operators, shareholders, employees and agents should third parties take action against Soda Studios or its operators, shareholders, employees and agents on the basis of your breach of contract. In the event that Soda Studios is entitled to damages and/or in the event of a breach of contract on your part, you consent to Soda Studios contacting you via the email address you provided.

Deletion of your personal website

Your personal website can be deleted at any time on request. Payments already made will not be refunded. Soda Studios is entitled to delete a personal website without notice for good cause and without prior notification. When a website is deleted, Soda Studios has the right and the obligation to delete all data that the member has posted on crazyinlove.ch or has received there.

General

This contract is governed by Swiss law. Soda Studios may be obliged, for legally valid, business or technical reasons, either to supplement the existing contract with further clauses or to amend the clauses currently in force. The individual sections of this contract are severable. If individual sections of this user agreement are deemed invalid or unenforceable, the section concerned may be removed. The other sections remain valid. In such circumstances, the new terms of use, together with the data protection provisions where applicable, will be published on the website and will take effect immediately upon their publication on the website. If you do not agree with the new provisions, you have the right to terminate your contract with Soda Studios by requesting the deletion of your website. However, payments already made will not be refunded. If Soda Studios does not respond in a particular case to a breach of the user agreement on your part, our right to take action against you in the event of a later breach remains entirely unaffected.
